Who it applies to

Article 95-3(1) of the Enforcement Decree. It applies when both parents are insured and both take leave for the same child before the child turns 18 months old. Their leave periods do not have to overlap.

The first 6 months pay each parent their own ordinary monthly wage, with a floor of ₩0.7M for each parent. From month 7 it is 80% of the ordinary wage, capped at ₩1.6M.

Cap for each month

For the first 6 months the cap rises month by month. The table is the longest case in the article, where each parent takes 6 months.

Cap on the monthly amount when both parents have each taken leave up to that month (Enforcement Decree art. 95-3(1)1).
MonthMonthly cap
Month 12,500,000 won
Month 22,500,000 won
Month 33,000,000 won
Month 43,500,000 won
Month 54,000,000 won
Month 64,500,000 won

When a cap applies

The cap depends on how long each parent takes. If each parent takes 3 months, the cap for month 3 is ₩3M. The month 4 cap of ₩3.5M is for parents who each take 4 months or more.

The article does not say what happens in a month when your spouse has taken less than you. The calculator treats that month as standard leave and marks it. The employment center decides what really applies.

Duration is set by article 19(2) of the Equal Employment Act. If both parents each take 3 months or more for the same child, you can take up to 6 more months, up to 18 months in total.
